Terms of Service for SeekTrace

1. Acceptance of These Terms

These Terms of Service (“Terms”) are a binding agreement between you (“you,” “User”) and Tivania OU, a company organized under the laws of Estonia (“SeekTrace,” “we,” “us,” “our”), governing your access to and use of the SeekTrace website, mobile applications, and related services (collectively, the “Service”).

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

2. Description of the Service

SeekTrace is a search and information-aggregation platform that allows users to look up publicly available and licensed third-party data associated with a phone number, email address, or username, for the purpose of helping individuals verify identities, screen unfamiliar contacts, and protect themselves from scams, fraud, and harassment.

SeekTrace is not a private investigator, a credit bureau, or an investigative agency, and does not independently verify the accuracy of the records it surfaces.

3. Permissible Use (Please Read Carefully)

SeekTrace is intended for personal, informational, and lawful use only. By using the Service, you represent and warrant that you will not use any information obtained through SeekTrace for any purpose prohibited by applicable law, including but not limited to:

  • Determining eligibility for credit, insurance, or employment;
  • Screening a tenant, sub-tenant, roommate, or lodger for housing purposes;
  • Any purpose that would require the report to qualify as a “consumer report” under the U.S. Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.;
  • Stalking, harassing, threatening, intimidating, or physically or financially harming any individual;
  • Making decisions about a person’s eligibility for a license or permit granted by a government entity;
  • Unsolicited marketing, spamming, or any activity violating applicable telemarketing or anti-spam laws (e.g., TCPA, CAN-SPAM);
  • Reselling, republishing, or redistributing bulk data obtained via the Service to third parties.

SeekTrace is not a “Consumer Reporting Agency” as defined by the FCRA, and the information provided through the Service does not constitute a “consumer report” as defined by the FCRA. You agree that you will not use SeekTrace, or any data obtained from it, as a factor in establishing an individual’s eligibility for credit, insurance, employment, housing, or any other purpose covered under the FCRA.

We reserve the right to suspend or terminate your account, without refund, if we have reason to believe you have used the Service for a prohibited purpose.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. By using SeekTrace, you represent that you meet this requirement.

5. Accounts

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You agree to provide accurate registration information and to keep it up to date.
  • You must notify us promptly at [email protected] if you suspect unauthorized use of your account.

6. Subscriptions, Trials, Billing, and Cancellation

  • Certain features require a paid subscription or a one-time report purchase. Prices are displayed at checkout and may change with notice.
  • Trial offers: If we offer a discounted or trial-priced introductory period, it will automatically convert into a recurring subscription at the standard price unless you cancel before the trial ends. The trial terms, price, and conversion date will be clearly disclosed before you provide payment information.
  • Subscriptions renew automatically until canceled. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period.
  • Refunds are governed by our Refund Policy. Except as required by law or as stated in that policy, payments are non-refundable.
  • Payment processing is handled by third-party payment processors (e.g., Stripe). We do not store your full card details.

7. Data Sources and No Guarantee of Accuracy

SeekTrace aggregates information from public records, proprietary databases, and licensed third-party data providers. We do not create the underlying data and cannot guarantee its accuracy, completeness, timeliness, or reliability. Records may be outdated, incomplete, associated with the wrong individual, or duplicated. You are solely responsible for independently verifying any information before relying on it for any decision.

8. Intellectual Property

The Service, including its design, software, text, graphics, and compiled search results (as a compilation), is owned by SeekTrace or its licensors and protected by intellectual property laws. You may not copy, scrape, reverse-engineer, resell, or create derivative works from the Service except as expressly permitted.

9. Prohibited Conduct

In addition to Section 3, you agree not to:

  • Use bots, scrapers, or automated means to access the Service without our written permission;
  • Attempt to bypass rate limits, paywalls, or access controls;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Misrepresent your identity or impersonate another person or entity;
  • Use the Service to violate any applicable local, state, national, or international law.

10. Third-Party Links and Services

The Service may link to or integrate third-party websites, data sources, or services that we do not control. We are not responsible for the content, accuracy, or practices of any third party.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEEKTRACE AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON ANY INFORMATION OBTAINED THROUGH IT. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless SeekTrace and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, violation of these Terms, or violation of any law or third-party right, including any use of Service data for an FCRA-prohibited purpose.

14. Governing Law

These Terms are governed by the laws of Estonia, without regard to its conflict-of-laws principles, except where mandatory consumer-protection law of your place of residence requires otherwise.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and close your account at any time.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via the Service or by email at least 7 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
